Kick panel notches

I have two pair of kick panels.
On both of the passenger kick panels, they are notched out at the top where they meet the dash.
On the drivers side, one is notched and one is not.  They both have the same part #2895567
What gives?

Ok I couldn't tell if that "notch" was a break or if it was supposed to be there.  Thought maybe it was one of those things they changed midway through production or something.

I've checked all the ones I have here and none of the driver's side ones are notched like your picture
